AAccess to and use of the website www.wineyou.it (hereinafter referred to as the "Site") are subject to the complete and unconditional acceptance of these General Terms and Conditions of Sale. The user/consumer (hereinafter referred to as the "User") is required to carefully read these terms before proceeding with accessing or using the Site and the related services. If the User does not agree to fully accept these terms, they are kindly requested to refrain from accessing the Site and using the services offered. By using the Site, the User implicitly accepts the terms in force at the time of access, without the need for any further explicit action.

Ownership of the site

This website is owned by Wineyou S.R.L., with its registered office located in Arese (MI), Via Statuto 8, VAT number 09673600962, and registered in the Milan Business Register with R.E.A. number MI-2105884. Information and Copyright All content on the site, including but not limited to images, logos, text, audio, video, and other materials, is protected by copyright and other intellectual property laws. Any form of reproduction, publication, distribution, or use, even partial, is prohibited without the prior written consent of Wineyou S.R.L.. The "Wineyou" brand and logo, as well as the name "Wineyou", are the exclusive property of Wineyou S.R.L. and may not be copied or used by third parties in any form without written permission from Wineyou S.R.L.

Conditions of Sale

These General Terms and Conditions of Sale govern the purchase of bottled wine, multiple bottle packs, and all other products related to the world of wine available on the online store registered under the domain www.wineyou.it . Wineyou sells alcoholic beverages exclusively to consumers who are at least 18 years of age. By placing an order, the consumer guarantees that both the purchaser and, if different, the recipient of the goods are over the age of 18. Prices are expressed in Euros and include Italian VAT. Shipping costs are fixed amounts, unless otherwise specified. Shipping may be free if the total order value exceeds a certain threshold, which will be communicated to the user before completing the purchase. The user will always be informed of the shipping costs before finalizing the purchase and proceeding with payment. The images accompanying the product descriptions may not perfectly represent the product's actual features and may differ in terms of color, size, or the presence of accessories not included in the purchased product. All purchase-related information is to be considered as generic informational material and is not to be interpreted as a representation of the specific features of an individual offer. The assigned carrier will have the right to request and verify a valid ID from the recipient at the time of delivery and may refuse to complete the delivery if the recipient is under 18 years of age. These General Terms and Conditions of Sale may be amended over time to comply with any legislative updates, market changes, or at Wineyou's discretion. Any such changes will be promptly published and made available on the website. Each new version of the terms will be drafted in compliance with applicable laws. The sales contract

To complete the purchase of one or more products on the website, the consumer must first register an account on the site and, once the cart is composed according to their preferences, fill out the order form by providing their personal details, shipping address, and a contact phone number, exclusively through the procedure available on the website. No other ordering methods are permitted unless specifically agreed upon with the consumer and upon their explicit request. Once the desired items have been placed in the virtual cart, the consumer may proceed to checkout, where they will be required to make payment using one of the following methods: credit card, PayPal, bank transfer, or cash on delivery. The sales contract is deemed concluded when Wineyou S.R.L. receives the order, verifies the data, and sends the consumer a confirmation email containing the details of the purchases made. The consumer will be asked, during the order submission process, to correct any errors in data entry or to provide any missing information. Additionally, the consumer will be required to confirm that they have read the General Terms and Conditions of Sale, Use, and Privacy Policy, and accept them by ticking the appropriate box. Once the contract is concluded, Wineyou S.R.L. will process the order. Wineyou S.R.L. reserves the right to refuse and/or not process the consumer’s order if the order is incomplete or incorrect, or in the case of unavailability of the desired products. In such cases, Wineyou S.R.L. will promptly inform the consumer via email, specifying the reasons and offering alternative solutions if applicable. The availability of products on the website is updated in real time. However, in the event of simultaneous requests from multiple consumers for the same product, unexpected unavailability may occur. In this case, Wineyou S.R.L. will immediately inform the consumer of the unavailability of the product and will offer one or more valid alternatives, such as products of equal or greater commercial value to fulfill the order. If no suitable alternative is available, Wineyou S.R.L. will issue a refund of the amount already paid via bank transfer. Upon successful payment, the consumer will receive a confirmation email containing all the information related to the purchased offer, including a summary of the delivery address and an order number or reference code. The shipment of the goods will occur within the timeframes specified in the order confirmation.

Legal Drinking Age

The purchase of alcoholic beverages is strictly reserved for individuals who have reached the legal drinking age according to the laws in force in the Customer’s country of residence. By placing an order, the Customer declares that they meet this requirement.

Payments

The available payment methods for the order are as follows: credit cards and prepaid cards from the Visa, Mastercard, Maestro, Postepay networks, PayPal (it is specified that, in case of order cancellation, the amount will be refunded to the consumer, minus the applicable PayPal fees), and bank transfer. The total price of the product displayed includes VAT (22%) and, if applicable, shipping costs, which will always be explicitly stated and shown separately both in the virtual cart and in the order summary and receipt. The charge for the amounts due occurs, unless otherwise specified in the terms of the offer, at the moment of payment confirmation. In the case of payment by bank transfer, upon order confirmation, the bank details (IBAN), the exact amount to be transferred, and the order number will be provided. The payment via bank transfer must be made within the timeframes indicated and, in any case, no later than 10 days from the order confirmation. After this period, Wineyou S.R.L. will not be able to guarantee the fulfillment of the order. In such cases, Wineyou S.R.L. will proceed to refund any amounts received beyond the stipulated timeframe, without any additional fees, via bank transfer. All payment data necessary for the electronic transaction will be transmitted and processed exclusively through secure cryptographic protocols managed by Nexi. Wineyou S.R.L. will not have access to the payment data and will not use it in any way.

Prices

All public prices displayed on the website are expressed in Euros and are to be understood as including Italian VAT (22%), unless otherwise stated. Shipping costs and any additional service fees, as well as any applicable discounts, whether in amount or percentage of the total order, are always explicitly stated separately in the virtual cart and will be shown again in the subsequent stages of the purchasing process, before the final order confirmation. The prices displayed on the website are subject to change without notice. In the event of an incorrect price being displayed, Wineyou S.R.L. reserves the right to cancel the order and refund the amount already paid by the consumer, foregoing the completion of the sale. 

Shipment

Wineyou guarantees order fulfillment generally within 24-48 hours of receiving payment and delivers using leading national and international couriers such as SDA, BRT, GLS, and others. For delivery times, see https://wineyou.it/en/content/1-shipment (any delays or issues are due to the courier and are absolutely not attributable to Wineyou S.R.L.). When available, the customer will be provided with the name of the courier and tracking information to track the shipment and verify its expected delivery date. Each courier reserves the right to verify the purchaser's identity, particularly that they are of legal age. Each shipment will be delivered to the address indicated by the customer on the order form. If no one is home at the time of delivery, the courier will leave a note with their contact information in the mailbox. If desired, you can contact the courier to arrange a new delivery. Otherwise, the courier will attempt to deliver to the same address again the following day. In the event of a second failed delivery, we will leave another notice. We will then contact you to arrange a collection. We recommend providing an address where someone will be available to collect the goods. Each shipment will be tracked online on the courier's website.

Returns

The packaging used for the shipment of products consists of a secure container designed to protect the contents from damage during transit. For additional consumer protection, all shipments are insured against breakage, theft, or loss. If the consumer receives one or more damaged products, or if the package is visibly damaged or stained due to wine spillage, the consumer is required to refuse delivery of the package. The consumer may send a photo of the damage along with a detailed description of the issue to the email address info@wineyou.it , so that the Company can verify the claim. In such cases, Wineyou S.R.L. will arrange for the return of the damaged package, replace it with a new one, and ship the replacement product to the consumer. In the event that the damaged products are out of stock, Wineyou S.R.L. will contact the consumer to offer the option of choosing substitute products or, alternatively, proceed with the refund of the amount paid. The consumer is required to verify the integrity of the package and the correctness of the contents at the time of delivery. If the consumer has any doubts about the condition of the package or contents, they have the right to accept the delivery "with reservation." In this case, they must report any damage or discrepancy within 48 hours of receiving the package. If the delivery is accepted without reservation, no returns of damaged products will be accepted. If one or more wines are affected by cork taint, the consumer may send an email to info@wineyou.it , specifying the order number, the quantity of affected products, and describing the issue. The consumer must also return the bottles considered defective, containing at least 2/3 of the contents and with the original cork. Upon receipt of the bottles, Wineyou S.R.L. will proceed with verifying the reported defect. If the defect is confirmed, the consumer will be entitled to receive an equivalent discount voucher or a replacement product, provided the report is made within 6 months from the date of purchase. If the defective bottles are not returned, no refund or replacement will be provided. Collection wines and wines from previous vintages are not eligible for replacement. Taxes and customs duties on alcohol

VAT and Pricing: All retail prices shown on the website include Italian VAT.

Customs Duties and Excise Taxes: Prices do not include any taxes, customs duties, excise duties, or other charges applicable in the destination country if different from Italy. Such costs, which vary from country to country, are entirely the responsibility of the Customer, who is required to verify the applicable amounts and payment procedures with the relevant local customs or tax authorities.

Legal Drinking Age: The purchase of alcoholic beverages is strictly reserved for individuals who have reached the legal drinking age according to the laws in force in the Customer’s country of residence. By placing an order, the Customer declares that they meet this requirement.

Import Restrictions: It is the Customer’s responsibility to verify that the laws of the destination country allow the importation of alcoholic beverages by private individuals. If the products are held, seized, or returned to the sender due to non-payment of customs duties or violation of local restrictions, any related shipping, return, and storage costs shall be borne by the Customer.

Points Collection Program

Wineyou S.R.L. offers its customers a points collection program that allows them to accumulate points with each purchase. The points can be used to obtain discounts on future purchases. Each euro spent corresponds to a certain number of points, which will be automatically credited to the user's account at the time of the order. The accumulated points are non-transferable, non-assignable, and non-convertible into cash. For each use of the points, Wineyou S.R.L. reserves the right to modify, suspend, or cancel the points collection program, with prior notice to customers, without any liability.

Legal Notice on the Points Collection Program

The points collection program is exclusively available to consumers registered on Wineyou.it and is automatically activated upon registration or the first purchase. The accumulated points are subject to applicable fiscal and legal regulations. Wineyou S.R.L. reserves the right to modify or suspend the points collection program at any time, without prior notice. Any changes to the terms of use of the points will be promptly communicated to users via the website or email. The accumulated points do not entitle the user to any interest or remuneration, and they cannot be transferred to third parties or used in contexts other than those provided by the program. The points collection program cannot be combined with other promotions, unless otherwise specified by Wineyou S.R.L. In the event of misuse of the points collection program, Wineyou S.R.L. reserves the right to cancel the accumulated points and suspend access to the program without any reimbursement for points already used or accumulated. Wineyou S.R.L. shall not be liable for direct or indirect damages arising from the suspension, modification, or cancellation of the points collection program, nor for any fraudulent use of the points. The terms and conditions related to the points collection program are subject to change without prior notice. It is the customer's responsibility to periodically consult the Terms and Conditions to check for any updates or modifications. In the event that any provision is declared invalid or ineffective, the remaining provisions will remain valid and effective. The points collection program is governed by Italian law, and any disputes arising from its use shall be subject to the exclusive jurisdiction of the Italian courts.

Jurisdiction

Any dispute regarding the execution, interpretation, and validity of this agreement shall be governed exclusively by Italian law. The parties agree to submit any dispute, within the limits of applicable legislation, to the exclusive jurisdiction of the Italian courts, with the competent venue being exclusively the Court of Milan.
